Australia Giveaway Competition Rules
Hourglass Cosmetics Sydney Popup Ambient Lighting Edit Palette Giveaway (“Competition”).
NO PURCHASE NECESSARY TO ENTER. ENTRY IS FREE. SKILL PLAYS NO PART IN DETERMINING THE WINNER.
1. ELIGIBILITY. The Competition is open to those natural persons aged 18 years or older, who are residents of Australia (“Entrants”). Entry is only available in person at the Hourglass Cosmetics Sydney Pop‑Up Shop during the Competition Period. Employees of Kingdom Animalia, LLC, (trading as Hourglass Cosmetics) (“Promoter” or “Hourglass”), its related bodies corporate, and members of their immediate family (spouse, parents, children, siblings, grandparents and household members) are not eligible to enter. This Competition is a game of chance conducted in accordance with the laws of New South Wales, Australia. No permit is required as the total prize value is under AUD $10,000. Void where prohibited by law. By entering, Entrants agree to be bound by these Official Rules, and Hourglass’s Privacy Policy (the “Rules”).
2. GIVEAWAY PERIOD. The Competition opens on February 26, 2026 at 9:00 AM Australian Eastern Daylight Time (“AEDT”) and closes on March 1, 2026 at 3.00PM AEDT (“Competition Period”). All entries must be received during the Competition Period. The Promoter’s records are final and conclusive as to the time of entry.
3. HOW TO ENTER. To enter, Entrants must, during the Competition Period: (i) visit the Hourglass Cosmetics Sydney Pop-up Shop; and (ii) complete the entry form made available at the pop-up location. Limit one (1) entry per person. Multiple entries, automated entries, or entries submitted using false identities will be deemed invalid. If there is a dispute regarding the identity of an Entrant, the Promoter reserves the right to require proof of identity and eligibility. Failure to provide such proof may result in disqualification.
4. WINNER SELECTION AND NOTIFICATION. The winner(s) will be selected by a random draw from all valid entries received during the Competition Period. The draw will take place promptly after the Competition Period ends. The winner will be notified by email within 30 days from the end time of the Competition Period. If the winner does not respond to the notification within 7 days, or if the Promoter is unable to contact the winner after reasonable attempts, the winner will have been deemed to have forfeited the prize. The Promoter may then conduct a further draw to award the prize to an alternative eligible Entrant. The winner agrees that the Promoter may publish their first name, last initial, and State/Territory of residence for the purpose of announcing the result of the Competition, as required under NSW trade promotion rules. No affidavits, declarations, or publicity releases are required as a condition of receiving the prize, except where required by law.
5. PRIZE AND ITS VALUE. The winner(s) of the Competition will receive the following prize: One Limited Edition Ambient Lighting Edit (Elephant) Palette. Retail value: AUD $164.00. This is the total prize for the Competition. No travel, accommodation, or additional benefits are included. Any expenses not expressly stated as part of the prize are the responsibility of the winner. The prize is not transferable, exchangeable, or redeemable for cash. If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute a prize of equal or greater value, subject to any applicable laws. The Promoter is not responsible for any loss, damage, or delay to the prize once it has been dispatched to the winner, including where incorrect contact details were provided at the time of entry. The prize is supplied “as is” and, to the extent permitted by law, the Promoter makes no warranties or representations regarding the prize other than those required under the Australian Consumer Law.
6. INTERFERENCE, DISRUPTION OR TECHNICAL ISSUES. If, for any reason, Hourglass is unable to conduct this Competition as planned – including due to tampering, unauthorised intervention, technical malfunction, or any cause beyond the Promoter’s reasonable control that affects the administration, security, fairness, or integrity of the Competition, Hourglass reserves the right (subject to any written direction from relevant authorities) to: disqualify any Entrant who tampers with the entry process or interferes with the Competition; and/or cancel, suspend, modify or terminate the Competition; and/or conduct a redraw from all eligible entries received up to the time of the disruption. To the extent permitted by law, the Promoter is not responsible for any technical issues, delays, or failures outside its reasonable control that affect the conduct of the Competition or the receipt of entries The Promoter reserves the right to take appropriate action against any individual who deliberately attempts to interfere with the proper conduct of the Competition.
7. PRIVACY. Personal information collected from Entrants will be handled in accordance with Hourglass’s Privacy Policy, which is located at https://www.hourglasscosmetics.com/en-au/pages/privacy-notice. The Promoter will use Entrants’ personal information for the purposes of administering the Competition, contacting the winner, and as otherwise required or permitted by law. Entrants may request access to, or correction of, their personal information in accordance with the Privacy Policy.
8. RELEASE AND LIMITATION OF LIABILITY. To the extent permitted by law, Entrants release and hold harmless the Promoter, its related bodies corporate, and their respective officers, employees and agents (“Released Parties”) from any loss, damage, injury or claim arising out of: their participation in the Competition; or the acceptance, use or enjoyment of the prize. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law. The Released Parties are not responsible for: (i) any incorrect or incomplete information provided by an Entrant; (ii) any lost, late, misdirected or invalid entries; (iii) any unauthorised interference with the Competition; (iv) any technical malfunction, delay or failure beyond the Promoter’s reasonable control; or (v) any injury, loss or damage suffered in connection with the Competition or the prize, except to the extent caused by the negligence of the Promoter. If any portion of the prize is not taken or is unable to be used, that portion will be forfeited and no compensation will be provided.
Any disputes arising in connection with the Competition will be governed by the laws of New South Wales, Australia, and the parties submit to the non‑exclusive jurisdiction of the courts of that State.
9. GENERAL CONDITIONS. These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes regarding the interpretation of these Terms will be determined in accordance with those laws, and the parties submit to the non‑exclusive jurisdiction of the courts of New South Wales.
The Promoter’s decisions in relation to the conduct of the Competition, the interpretation of these Terms, and the determination of the winner are final, and no correspondence will be entered into. Failure by the Promoter to enforce any provision of these Terms does not constitute a waiver of that provision.
By entering the Competition, Entrants consent to the Promoter using their first name, last initial, and State/Territory of residence for the purpose of announcing the winner, as required by law. Any additional use of an Entrant’s image or likeness for promotional purposes will only occur with the Entrant’s consent.
Entrants will be added to the Promoter’s marketing database in accordance with the Promoter’s Privacy Policy and may opt out at any time.
